Special Concerns for California Credit Repair CompaniesAs is often the case, when there are people in need, there are those who would try to take advantage. Credit repair is no exception.
To help protect consumers from becoming a victim of a credit repair scam, the federal Credit Repair Organizations Act requires all credit repair companies to follow certain rules such as not charging for services before they are performed, having a contract in place before any work is done, and providing customers with a written statement of their rights under the Fair Credit Reporting Act. In addition to these rules, California Credit Services Act of 1984 requires even more of companies who offer credit improvement services.
According to this law, all credit services organizations must:
- Register with the California Attorney General's Office before doing business in the state.
- Obtain a $100,000 surety bond.
- Allow customers to cancel service free of charge by midnight of the fifth day after the contract is signed
- Complete the agreed services within six months after the date the contract is signed.
